Court and Coroner Related Costs (M19)

Scope of Appropriation
This appropriation is limited to funding professional and administrative services provided to or directed by courts and coroners, including costs that are required by legislation and costs incurred by Visiting Justices.
Reasons for Change in Appropriation

The appropriation decreased by $700,000 to $117.348 million for 2019/20 due to a fiscally neutral adjustment to the Judicial Review Costs appropriation to cover increased judicially ordered payments being made from the Maori Land Court Special Aid Fund.

District Court Part-time or Acting Judges' Salaries and Allowances (M19)

Scope of Appropriation
This appropriation is limited to the remuneration and allowances of part-time and acting Judges in the District Court, including the Environment Court.
Reasons for Change in Appropriation

This appropriation decreased by $1.694 million to $17.937 million for 2019/20 due to:

  • a fiscally neutral adjustment of $3.200 million to Vote Justice to fund the Human Rights Commission to undertake work on hate speech and discrimination, and for the second phase of the 'Give Nothing to Racism' campaign, and
  • a fiscally neutral adjustment of $1.694 million to address increased security costs allocated through overheads across Vote Courts, Vote Justice and Vote Treaty Negotiations.

This was partially offset by an expense transfer of $3.200 million from 2018/19 to 2019/20 of un-used funding which was then transferred to Vote Justice to fund work by the Human Rights Commission.

Scope of Appropriation
Cost of legal services (including settlement of claims) in cases involving the exercise of judicial functions or the execution of judicial process or costs of counsel to assist the court, including payments ordered to be made from the Maori Land Court Special Aid Fund.
Reasons for Change in Appropriation

This appropriation increased by $700,000 to $2.246 million for 2019/20 due to a fiscally neutral adjustment from the Court and Coroner Related Costs appropriation to cover increased judicially ordered payments being made from the Maori Land Court Special Aid Fund.

Reasons for Change in Appropriation

The appropriation decreased by $3.800 million to $19.597 million for 2019/20 due to an expense transfer from 2019/20 to 2020/21 for the Canterbury Earthquake Insurance Tribunal due to delayed setup of the Tribunal.

Reasons for Change in Appropriation

This appropriation increased by $23.126 million to $527.921 million for 2019/20 due to:

  • an increase of $8.080 million to fund increased depreciation expense as a result of property revaluations
  • an increase of $4.778 million for the Whenua Maori Programme, a cross agency programme with Te Puni Kokiri and the Maori Land Court
  • an increase of $2.834 million to address pressures on the court system resulting from the Christchurch terror attacks trial
  • a fiscally neutral adjustment of $2.526 million relating to the sale and lease-back of properties under treaty settlements
  • an increase in capital charge of $1.965 million due to the revaluation of land and buildings as at 30 June 2019
  • a fiscally neutral adjustment of $1.516 million from District Court Part-time or Acting Judges' Salaries and Allowances appropriation to address increased security costs within the Courts
  • an increase of $864,000 to scope and set-up an additional Alcohol and Other Drug Treatment Court in Waikato, funded from the Proceeds of Crime Fund
  • a fiscally neutral adjustment of $828,000 for employees seconded to other government agencies
  • a fiscally neutral adjustment of $775,000 to assist with hosting the 2020 International Association of Women Judges Conference in New Zealand, with costs reimbursed by third parties
  • a fiscally neutral adjustment of $613,000 to support the professional development of Pacific judicial and court officers
  • a fiscally neutral adjustment of $497,000 for the development of an automated system for Criminal Record checks, funded by third parties
  • an increase of $300,000 for preliminary work to establish an innovative courthouse in Tauranga, and
  • a fiscally neutral adjustment of $80,000 for 2019/20 to fund the Marceau National Oversight Group established in response to the coronial findings into the death of Christie Marceau.

This was partially offset by:

  • a fiscally neutral adjustment of $2.230 million to Vote Justice and Vote Treaty Negotiations to reflect the allocation of Ministry overheads in 2019/20, and
  • a fiscally neutral adjustment of $300,000 to Vote Justice to undertake work on phase two of the Law Commission's recommendations on sexual violence proceedings.
